Purpose and Scope
MakeMyYear.com provides an online tool that allows you to create, personalise and download calendar files (“digital content”). Unless we state otherwise, we do not supply printed products.
The service is provided for personal and business use, subject to these terms.
Accounts, Subscription and Access
Certain features may require you to register for an account and/or subscribe. You are responsible for keeping your login credentials confidential and for all activity on your account.
Subscription fees, billing frequency and any included credits are described on the website at the time you subscribe. Included credits and plan features may change over time. Changes will apply from your next renewal unless we state otherwise.
Digital Content and Personalisation
The service enables you to generate calendar files based on information you enter and any text or images you upload. You are responsible for checking the accuracy of your inputs (including names, spellings, dates, times and images) before downloading.
We do not guarantee that dates, holidays or events shown are complete, up to date or error-free. You should verify any important dates independently before relying on them.
Printing quality and output will depend on your printer, print settings, paper and any third-party printing service you choose. We are not responsible for third-party printing or manufacturing.
Acceptable Use
You must not misuse the website. In particular, you must not:
- attempt to disrupt, damage, overburden or impair the website or its security;
- use automated systems (including bots or scrapers) to access, extract or harvest data without our written permission;
- upload or submit unlawful, infringing, defamatory or harmful content;
- attempt to access accounts, systems or data you are not authorised to access.
You may use the service only for lawful purposes.
Intellectual Property
All website code, design, layout, branding and underlying content belonging to MakeMyYear.com are owned by us or our licensors. These terms do not transfer any ownership rights to you.
You retain ownership of the text and images you upload. By using the service, you grant us a limited, non-exclusive, worldwide licence to host, use and process that material solely to provide the service and generate your calendar files. This licence lasts only for as long as reasonably necessary to provide the service to you.
Unless we explicitly permit it, calendar files and designs provided by the service are for your own personal or internal business use only. You must not resell, redistribute, publish or make them available to third parties as standalone products.
Data, Storage and Backups
We may store your events and related data to provide the service. However, you should treat the service as a tool rather than a secure archive.
- Your data are not guaranteed to be backed up. If your events data are important to you, export your events data after each change.
Cooling-Off, Cancellations and Refunds (Digital Content)
If you are a UK/EU consumer, you may have a statutory right to cancel certain purchases within 14 days. However, for digital content supplied immediately, that right can be lost once delivery begins.
Where your subscription provides immediate access to downloadable digital content, you agree that we may make digital content available to you immediately after purchase. You acknowledge that you may lose your statutory right to cancel once the digital content is made available for download or access, to the extent permitted by law.
Any refunds we choose to offer outside of your statutory rights will be handled in accordance with any refund policy stated on the website at the time of purchase.
Availability and Changes to the Service
We aim to keep the service available, but we do not guarantee uninterrupted or error-free operation. We may suspend, withdraw, update or change the service (in whole or in part) at any time, including for maintenance, security, legal or operational reasons.
Continued use of the service after changes to these terms means you accept the revised terms.
Termination
We may suspend or terminate your access if we reasonably believe you have breached these terms or used the service unlawfully or abusively. You may stop using the service at any time.
Liability
Nothing in these terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- any other liability which cannot be excluded or limited by law.
Subject to the above, and to the fullest extent permitted by law:
- we are not liable for any loss or damage arising from your use of, or inability to use, the service, where such loss could have been avoided by verifying important dates or checking your personalisation inputs; and
- we are not liable for indirect or consequential loss, including loss of profit, loss of business, loss of goodwill, or loss of data.
Liability cap: Subject to the above, our total liability to you arising out of or in connection with these terms or the service (whether in contract, tort (including negligence) or otherwise) will not exceed the total subscription fees paid by you in the 12 months immediately preceding the event giving rise to the claim.
Governing Law
These terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
